Defects not Apparent on Inspection. 12.1. The Buyer shall only be entitled to claim (and then subject to Conditions F to I and 13) in respect of defects in the goods supplied and/or services performed which are not apparent on visual inspection at the time of delivery or completion of performance, if the goods and/or services are subject to final commission testing. It is the Buyer's responsibility to provide a relevant witness in attendance at the commission testing who will acknowledge the testing and sign the commissioning report sheets presented by the Company. Should the Buyer fail to commission the goods within 60 days of completion of the installation, the goods shall be deemed free from defect, subject always to the Defects Liability Period.

It is the Buyer's responsibility to provide a relevant witness in attendance at the commission testing who will acknowledge the testing and sign the commissioning report sheets presented by the Company. Should the Buyer fail to commission the goods within 60 days of completion of the installation, the goods shall be deemed free from defect, subject always to the Defects Liability Period.
