Common use of Definition of Vacancy Clause in Contracts

Definition of Vacancy. If a position becomes open at a site due to resignation, non-retention, termination of employment, leave of absence, reassignment to another position in the District, or because of the creation of a new position at the site, teachers assigned to the site shall be reassigned as allowed by this Article. Upon completion of those reassignments, the remaining open position shall be considered the vacancy for which other teachers may request voluntary transfers.
