Permanent Vacancy. A permanent vacancy is created when the Employer determines to increase the workforce and to fill a new position or when any of the following personnel transactions take place in the bargaining unit, and the Employer determines to replace the previous incumbent: terminations, promotions or demotions.

Where the applicant has been selected in accordance with this Article and it is subsequently determined that she cannot satisfactorily perform the job to which she was promoted, the Home will attempt, during the first sixty (60) tours from the date on which the nurse was first assigned to the vacancy, to return her former job and the filling of subsequent vacancies will likewise be reversed.
