Delivery of Survey. Subject to clauses 12 and 16.1, Nearmap will deliver the Survey to the Licensee by uploading the Survey to the Website within 6 months of the date on which Nearmap receives payment of the Survey Fee in full from the Licensee. Nearmap will notify the Licensee in writing once the Survey has been uploaded to the Website. Availability to other Nearmap customers Nearmap may, at its absolute discretion, allow other customers of Nearmap to access the Survey on the Website. Refund of Survey Fee If the Licensee is not in breach of the Agreement and Nearmap elects to terminate the Agreement under clause 6.4 prior to delivery of the Survey, Nearmap will refund the Survey Fee to the Licensee. During the Term the Licensee may contact Nearmap at xxxx://xxxxxxx.xxxxxxx.xxx with the Licensee’s support queries. However, Nearmap cannot guarantee that it will be able to resolve any issue raised by the Licensee. Nearmap has no obligation to provide the Licensee with any additional support, but if Nearmap agrees to do so Nearmap may charge the Licensee reasonable additional fees for the additional support provided to the Licensee by Nearmap.
Delivery of Survey. Buyer, at Buyer’s sole cost and expense, may obtain a survey of the Property within twenty-one (21) calendar days after the Effective Date.

At Developer's expense, Developer shall deliver to Mall II LLC, at the Closing, an "as-built" survey (dated or updated to a date not earlier than sixty (60) days before the Closing Date) which shows the Phase II Mall as constructed within the Building at the point of construction as of such date. Upon completion of construction of the Development, Developer shall deliver a final version of such survey, showing the Development "as-built."

Within thirty (30) days following the Effective Date, JBC, at its sole cost and expense, shall deliver or cause to be delivered to XRG a survey ("Survey") of the Real Estate which shall: (i) reflect the actual dimensions of, and area within, the Real Estate, the location of any easements, setback lines, encroachments, or overlaps thereon or thereover, and the outside boundary lines of all improvements; (ii) identify by recording reference all easements, setback lines, and other matters referred to on the Title Commitment; (iii) reflect that there is access to and from the Real Estate from a publicly dedicated street or road; (iv) reflect any area within the Real Estate that has been designated by any federal, state, or local governmental agency or body as being subject to special, or increased, flooding hazards; and (v) include a surveyor's certification, reasonably acceptable to XRG and sufficient to cause the Title Company to delete any survey exception on the owner's title policy. The surveyor shall compile a metes and bounds description of the Real Estate from the information contained within the Survey and this description shall be used in the documents executed at Closing and such field notes shall be incorporated herein by this reference upon their completion and approval by XRG.
Delivery of Survey. NBU does not have a survey of the Property. If the City or the title insurance company requires a survey of the Property, the City will obtain a survey (“Survey”) of the Property and provide a copy of the Survey to NBU no later than seven (7) days before the Transfer Date. If the City obtains a Survey under this provision, NBU and the City agree to use the metes and bounds description resulting from the Survey as the legal description of the Property in all Transfer Documents (defined below) upon the reasonable acceptance of the Survey by both parties.
