DEMAND RESPONSE If Customer is enrolled in a demand response programme, Customer represents and warrants it has the intent and ability to generate and/or reduce electrical demand to achieve Accepted Capacity (as defined in the applicable Programme Rule Attachment attached to the applicable Order Form) when notified by Provider during demand response events. If Customer is enrolled in a demand response programme utilising on-site electric generation, Customer further represents and warrants that (i) it holds all licenses and/or permits that are required by applicable law for the proper participation in such demand response programme; and (ii) when responding to a demand response event, it will comply with, and be responsible for any violation of applicable law.
CAFA Notice Pursuant to 28 U.S.C. § 1715, not later than ten (10) days after the Agreement is filed with the Court, the Settlement Administrator shall cause to be served upon the Attorneys General of each U.S. State in which Settlement Class members reside, the Attorney General of the United States, and other required government officials, notice of the proposed settlement as required by law, subject to Paragraph 5.1 below.
Response to Demand Letter Within 10 days after the receipt of the Demand Letter, Post Acute Medical shall either: (a) cure the breach to OIG’s satisfaction and pay the applicable Stipulated Penalties or (b) request a hearing before an HHS administrative law judge (ALJ) to dispute OIG’s determination of noncompliance, pursuant to the agreed upon provisions set forth below in Section X.E. In the event Post Acute Medical elects to request an ALJ hearing, the Stipulated Penalties shall continue to accrue until Post Acute Medical cures, to OIG’s satisfaction, the alleged breach in dispute. Failure to respond to the Demand Letter in one of these two manners within the allowed time period shall be considered a material breach of this CIA and shall be grounds for exclusion under Section X.D.
Notice of Displacement Where a notice of displacement or layoff actually results in a layoff, and prior to the layoff becoming effective, two (2) copies of such notice shall be sent to the Local designate.
Class Notice The Settling Parties have presented to the Court proposed forms of Settlement Notice, which are appended hereto as Exhibit 3 and Exhibit 4, respectively.
Response to Notice Within ten business days of receiving the Claim Notice, the Respondent must notify the Claimant of its representative to negotiate the dispute.
Demand Letter If OIG determines that a basis for Stipulated Penalties under Section X.A exists, OIG shall notify Provider of: (a) Provider’s failure to comply and (b) OIG’s demand for payment of Stipulated Penalties. (This notification shall be referred to as the “Demand Letter.”)
Firm Response The Department should make an award within sixty (60) days after the date of the opening, during which period responses shall remain firm and shall not be withdrawn. If award is not made within sixty (60) days, the response shall remain firm until either the Department awards the Contract or the Department receives from the bidder written notice that the response is withdrawn. Any response that expresses a shorter duration should, in the Department's sole discretion, be accepted or rejected.
Notice of Discipline All notices of disciplinary action shall include a statement of the reasons therefor and a statement advising the employee that the action is subject to Article 20,
