Common use of Demand to Return Clause in Contracts

Demand to Return. Upon initial request to return from an on-the-job injury to a permanent position, certification by the attending physician that the physician releases the employee to return to his/her regular employment shall be prima facie evidence that the employee should be able to perform such duties. This does not, however, preclude the LTCO from obtaining further information relative to the Employee’s condition.
