Common use of Department of Administrative Services Clause in Contracts

Department of Administrative Services. When the Agency chooses to make a shift reassignment, all employees in the affected classification will be notified by publication in the manner provided for in Article 45.5E-- Filling of Vacancies, Section (b), and be given an opportunity to designate their shift preference. The reassignment will be made based on each employee’s level of skill, the requirements of the reassignment, and the operating needs of the Agency. If more employees request the shift reassignment than there are reassignments available, and are, in the judgment of the Agency, equally well qualified for the reassignment and equally meet the operating needs of the Agency, the employee with the most seniority will be given the reassignment. The Agency shall not exercise its judgment in an arbitrary manner.
