Department Right to Oversee Work. (a) The DB Contractor acknowledges and agrees that, pursuant to Section 10.02 of the CA, the Department will have the right at all times during the CA Term to carry out Oversight Services with respect to all aspects of the design, permitting, financing, acquisition, construction, installation, equipping, maintenance, repair, preservation, modification, operation, management and administration of the Project. The Department’s Oversight Services will not impact its right to rely on the Concessionaire to perform its obligations pursuant to the Comprehensive Agreement or the Concessionaire’s right to rely on the DB Contractor to perform its obligations pursuant to this Agreement.

  • Procurement of Small Works Works estimated to cost less than $100,000 equivalent per contract, up to an aggregate amount not to exceed $1,150,000 equivalent, may be procured under lump-sum, fixed-price contracts awarded on the basis of quotations obtained from three (3) qualified domestic contractors in response to a written invitation.   • COMPENSATION FOR CONSTRUCTION PHASE SERVICES 5.1 For the Construction Manager’s performance of the Work as described in Section 2.3, the Owner shall pay the Construction Manager the Contract Sum in current funds. The Contract Sum is the Cost of the Work as defined in Section 6.1.1 plus the Construction Manager’s Fee.
