DESCRIPTION OF MATERIALS AND EQUIPMENT. 5.3.1 Any brand name or manufacturer reference used herein is intended to be descriptive and not restrictive, unless otherwise noted, and is used to indicate the type and quality of material. The term "or equal" if used, identifies commercially produced items that have the essential performance and salient characteristics of the brand name stated in the item description. 5.3.2 All supplies, material, or equipment shall be new and of the most suitable grade for the purpose intended. For clarification, "new" includes products containing recovered materials that are EPA-designated items. It is not the Client's intent to discriminate against any materials or equipment of equal merit to those specified. However, if Vendor desires to use any substitutions, prior written approval must be obtained from the Client and sufficiently in advance such that an addendum may be issued. 5.3.3 The Vendor warrants that the labor and materials furnished under the Agreement will be of good quality and new unless otherwise required or permitted under the specifications, that the work and materials will be free from defects not inherent in the quality required or permitted, and that the Work and Services will conform to the requirements of the specifications. Work, Services and materials not conforming to the specifications, including substitutions not properly approved and authorized, may be considered defective and will be rejected by the Client. Unless otherwise noted by Client, the Vendor shall abide by specific manufacturer instructions and recommendations on installation and operation.

  • Quality of Materials and workmanship The Contractor shall ensure that the Construction, Materials and workmanship are in accordance with the requirements specified in this Agreement, Specifications and Standards and Good Industry Practice.

  • Removal of Materials If you decide you would like to remove your Materials from the Service, you may provide written notice to Prime Publishing by either deleting the image through the Prime Publishing interface or by contacting Prime Publishing customer service, and Prime Publishing will remove such Materials from the Service within a reasonable period of time. 5) License for Name, Trademarks and Likenesses.
