Common use of Design-Builder to Monitor Clause in Contracts

Design-Builder to Monitor. The Owner and the Design-Builder agree that the amounts so established will be monitored by both parties and used by the Design-Builder, with approvals as specified by the Owner, to provide for the cost of labor, materials, services, or equipment that are properly reimbursable as a Cost of the Work but that will not be the basis of a Change Order to adjust the GMP. The balances of all contingency funds will be returned to the Owner at the completion of the project. The Design-Builder will provide a full accounting of the status of the contingency funds to the Owner on a quarterly basis until the Project is completed, notwithstanding any change to a Lump Sum Price as permitted by Article 3.3.6.
