Common use of Determination of Permanent Vacancy Clause in Contracts

Determination of Permanent Vacancy. When a permanent position is vacant and has been posted in accordance with Article 18 and the vacancy still exists, the Employer may fill the position on a temporary basis by a substitute. A substitute shall be defined as a person with the necessary qualifications and skills to fill the position on an ongoing basis. The position will be posted during the time there is a temporary employee. This will extend until the position is filled.
