Initiation of a Grievance. A. The Union may in its discretion, in cases of suspension, demotion or dismissal only, skip step 1 of the Grievance Procedure and take a grievance directly to step 2 – the Chief Administrative Officer or his/her designee. If the Union exercises its discretion pursuant to this subsection, it will so notify in writing the Chief Administrative Officer upon filing the grievance.
B. At the option of the Union, a grievance may be presented informally by a local representative of the Union or designee of the Union to MCFRS Labor Relations Officer or designee for resolution. If the grievance is not resolved at that stage, it may be processed as provided below.
Initiation of a Grievance. Each grievance shall have to be initiated within ten (10) working days of the occurrence of the cause for complaint or, if neither the aggrieved nor the Union had knowledge of said occurrence at the time of its happening, then within ten (10) working days after the Union or the aggrieved becomes, or reasonably should have become, aware of the cause for the complaint.
Initiation of a Grievance. At Stage 1-Consultation, Individual or Group grievances shall be initiated to the appropriate Department Management Supervisor and at Stage 2-Formal Review to the appropriate Branch Manager or their designate. Policy grievances and Jurisdictional disputes shall be initiated at Stage 1- Consultation to the Senior Negotiator in the Labour Relations Section or their designate and, at Stage 2-Formal Review, to the Human Resources Branch Manager or their designate. The grievance shall be initiated in writing and shall specify: the nature of the grievance, the clause or article number of the Agreement upon which the grievance is based, and the remedy requested. A copy of all grievance correspondence, including decisions reached by Department Management, shall be provided to the Labour Relations Section, Human Resources Branch.
Initiation of a Grievance. 1. Employees shall first discuss their grievances with the proper members of the administrative staff, with full assurance that such discussion shall in no way prejudice their status with the school system.
2. The employee has the option of inviting a colleague to be with him at the time he/she discusses the grievance with an administrator at Level One and an Association Representative at Levels Two, Three and Four. The administrator has the option of inviting a colleague to be present when the grievance is discussed.
3. If a grievance cannot be resolved through informal means, the grievant shall follow the steps below to affect a satisfactory solution to a grievance.
4. No grievance shall be recognized by the Board or its designees unless it was presented at Level One within fifteen (15) calendar days after the aggrieved person knew or should have known of the event upon which it is based. If not so presented, the grievance shall be considered waived.
5. The time limits may be extended in writing, by mutual agreement between the administration and the grievant.
Initiation of a Grievance. Any grievance initiated pursuant to these procedures shall be initiated within thirty (30) days of the occurrence of the matter to be grieved, or within thirty (30) days of when a reasonable person would or should have knowledge of such event, but in no case may a grievance be filed in excess of one-hundred eighty (180) calendar days from the date of such occurrence. Failure of any teacher or the Association to act on a grievance within the prescribed time limits will act as a bar to any further processing thereof.
Initiation of a Grievance. All formal grievances filed on behalf of employees must be initiated by the Association.
Initiation of a Grievance. A grievance under the Agreement may be initiated by employees in the bargaining unit either singularly or jointly. All alleged violations arising from the underlying incident must be consolidated into a single grievance.
Initiation of a Grievance. A grievance regarding whether good cause exists for terminating a lease shall be initiated by a tenant in writing and shall be mailed or delivered to the NHA at its main office within seven (7) days after a notice of lease termination has been given to tenant by the NHA.
Initiation of a Grievance. 1. Any professor/instructor or group of professors/instructors represented by the Faculty Senate or the Faculty Senate as a collective agent may initiate a grievance relating to salaries, terms or conditions of employment, or of procedures in disciplining a professor/instructor, or any condition affecting wages, hours or conditions of employment in the following instances:
a. If there has been a violation, misinterpretation, or misapplication of any provision of this agreement (and/or letters of understanding) between the Xxxx Oaks Faculty Senate and the Board of Trustees.
b. If there are adopted Board of Trustee policies or administrative regulations or directives which violate the terms of this Agreement.
c. If there has been a violation, misinterpretation, or misapplication of statutory and/or constitutional provisions, except for statutes which specifically establish a procedure for redress.
2. The "aggrieved person" is the person or persons initiating the grievance. The term "days" shall mean business days (excluding holidays in the academic calendar).
Initiation of a Grievance. If a student believes that the actions of a faculty member have resulted in serious academic injury, it is the student’s responsibility to attempt to resolve the matter informally by meeting first with the faculty member, and then, if the student is not satisfied, with the chairperson (if there is one), then the xxxx.
