DIPLOMATIC AND CONSULAR OFFICIALS. 1. Nothing in this Agreement shall affect the fiscal privileges of members of diplomatic missions and their personal domestics, of members of consular missions, or of members of permanent missions to international organizations under the general rules of international law or under the provisions of special agreements. 2. Notwithstanding paragraph 1 of Article 4, an individual who is a member of the diplomatic, consular or permanent mission of a Contracting State which is situated in the other State and who is subject to tax in that other State only if he derives income from sources therein, shall not be deemed to be a resident of that other State.

(1. ) Nothing in this Agreement shall affect the fiscal diplomatic or consular privileges of members of diplomatic missions and their personal domestics, of members of consular missions, or of members of permanent missions to international organizations under the general rules of international law or under the provisions of special agreements. (2. Notwithstanding paragraph 1 ) For the purposes of Article 4this Agreement, an individual persons who is are members of a member of the diplomatic, diplomatic or consular or permanent mission of a Contracting State which is situated in the other Contracting State or in a third State and who is subject to tax in that other State only if he derives income from sources thereinare nationals of the sending State, shall not be deemed to be a resident residents of the sending State if they are subjected therein to the same obligations in respect of taxes on income and capital as are residents of that other State.
