Direct Notice via U.S. Mail. No later than the Notice Date, the Settlement 6 Administrator shall send notice substantially in the form attached as Exhibit B and a postcard 7 Claim Form with return postage prepaid via First Class U.S. Mail to all Settlement Class Members 8 whose U.S. Mail address is available in the Class List. In the event that claims representing fewer 9 than 50,000 CPU purchases have been submitted by the date that is thirty (30) days prior to the 10 Claims Deadline, the Settlement Administrator shall again send notice substantially in the form 11 attached as Exhibit B and a postcard Claim Form with return postage prepaid via First Class U.S. 12 Mail to all Settlement Class Members whose U.S. Mail address is available in the Class List.
Direct Notice via U.S. Mail. No later than the Notice Date, the Settlement Administrator shall send Notice via U.S. Mail substantially in the form attached as Exhibit B, along with a copy of the Claim Form, to all Damages Settlement Subclass Members for whom a valid postal address is contained in the Settlement Class List after taking reasonable steps to update those addresses, including using the National Change of Address database and other available resources deemed suitable by the Settlement Administrator. The Settlement Administrator shall take all reasonable steps to obtain the correct address of any Damages Settlement Subclass Members for whom U.S. Mail Notice is returned by the U.S. Postal Service as undeliverable and shall attempt re- mailings.
