Common use of Discharge of Violators Clause in Contracts

Discharge of Violators. The Agencies shall have the right to discharge or otherwise discipline any or all employees who violate any of the provisions of Paragraph B. In such event, the employee or employees, or the Union on their behalf shall have no recourse to the grievance procedure and arbitration, except for the sole purpose of determining whether an employee or employees participated in the action prohibited by Paragraph B. If it is determined that an employee did so participate, the disciplinary action taken by the Agency may not be disturbed. In the taking of such disciplinary action, the Agency will not discriminate among employees in accordance with Article XXVII.
