Common use of Disciplinary Procedure – Summary Dismissal Clause in Contracts

Disciplinary Procedure – Summary Dismissal. Where it is alleged that an Employees’ conduct may warrant summary dismissal the Employer will investigate the incident. The Employer will then provide the Employee an opportunity to respond to the allegation/s prior to making a final determination. If the Employer is then satisfied that the Employee conduct was serious misconduct then the Employer may terminate the Employees employment without notice.
