Common use of Discretionary Service Clause in Contracts

Discretionary Service. The Credit Union offers Courtesy Pay to all eligible consumer checking Account Owners. If you would like the Credit Union to provide Courtesy Pay for debit-card purchase transactions, you must specifically notify us to do so ("opt in"), as outlined in the Opt-In Disclosure that we provide you when you open your account. For all other overdraft transactions, Courtesy Pay will be provided automatically once a checking account has been opened and qualified for the service and will continue as long as the account is maintained in good standing with the Credit Union. Under Courtesy Pay, we are not obligated to pay any check or item presented for payment if your account does not contain sufficient funds. The Credit Union may, as a discretionary service and not as a right of yours or our obligation to you, pay overdrafts up to an approved overdraft limit under the terms of Courtesy Pay and subject to this Agreement. Courtesy Pay is not a line of credit, is not guaranteed, and is independent of any other payment arrangement that we may offer. Also, we may refuse to pay an overdraft for you at any time, even if we have previously paid overdrafts for you. Via your mailed (or e-mailed, if you have so requested) periodic statement, we will notify you of any insufficient funds, checks, or items paid or unpaid and returned that you may have. However, we have no obligation to notify you before we pay or return any item.
