Dismissal - Misconduct. Notwithstanding other provisions of this clause, the Company has the right to dismiss any employee without notice for misconduct following a three day suspension period with pay to allow for a full investigation into the incident, and where it has been clearly demonstrated that the employee’s behaviour amounts to conduct that justifies instant dismissal. To protect the interests of all employees and the company, employment may be terminated without notice if, after reasonable investigation, an employee is found guilty of an act of gross misconduct that justifies instant dismissal.
