Disputes with Others. Additional clause 23 23.1 If any difference arises between the Contractor and Others, the Contractor uses its best endeavours to achieve reconciliation. If the reconciliation is not achieved and is not likely to be achieved before such difference becomes detrimental to the delivery of the Works, the Contractor refers the matter or difference to the Employer for instructions.

Disputes with Others. If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint venturers and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and PJS-632082-1-34-V1PJS-632082-1-34-V1User Agreement.docx:JG unknown, arising out of or in any way connected with such disputes. Subject to other terms in this agreement, this release does not apply where Xxxx’s Rural Services' acts or omissions were a direct cause of the matters giving rise to the dispute.
Disputes with Others. You and ERA agree that a decision of an arbitrator, mediator or court of competent jurisdiction in arbitration, mediation or litigation to which one of them is not a party will not in any manner prevent the person that was a party to such action from making similar arguments or taking similar positions in any action between you and ERA. You and ERA each waive the right to assert that principles of collateral estoppel prevent either you or ERA from raising any claim or defense in an action between you and ERA as a result of such party having lost a similar claim or defense in another action.
Disputes with Others. We reserve the right, but have no obligation, to monitor and/or manage disputes between you and other Users. If you have a dispute with another User, you release the Umbrella Parties, and hereby agree to indemnify them from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of, or in any way connected with, such a dispute.

  • Transactions with Related Parties Enter into or be a party to any transaction or arrangement, including, without limitation, the purchase, sale lease or exchange of property or the rendering of any service, with any Related Party, except in the ordinary course of and pursuant to the reasonable requirements of the Borrower's or the applicable Subsidiary's business and upon fair and reasonable terms no less favorable to the Borrower or such Subsidiary than would obtain in a comparable arm's-length transaction with a Person not a Related Party.
