THE WORKS. 3.1 The Contractor undertakes to execute the Works in a proper and workmanlike manner against payment of the Contract Price referred to in clause 4 of this Agreement.
3.2 The Works shall be substantially in accordance with the Plan and Basic Specifications. The placement of the Works will be in accordance with the approved Building Plan.
3.3 In the event of any discrepancy arising from the Plan and the Basic Specifications, the provisions of the Basic Specifications shall prevail.
3.4 The Employer irrevocably grants a power of attorney to the Contractor to sign and submit the necessary drawings and specifications to the Local Authority for its approval.
THE WORKS. 27.1 The Seller undertakes to execute the Works which will on finalization constitute the Dwelling in a proper and workmanlike manner against payment or guarantee of the Purchase Price as defined and referred to in Clause 1.5 of this Agreement of sale. The Seller shall employ a qualified and reputable builder who is a registered home builder with the NHBRC and shall conclude with such builder a standard JBCC contract or similar contract.
27.2 The Works shall be substantially in accordance with the Plan of the Dwelling, the Specifications of the Dwelling and the Extras to be added attached hereto.
27.3 If for whatever reason, approval of the building plans and specifications cannot be obtained and/or any materials cannot be supplied to the Seller, the Seller shall be entitled in its discretion to deviate from the Plan of the Dwelling, the Specifications of the Dwelling and Extras (which may for example cause variances in both the paint or tiles or other furnishes) if, during the planning, building and construction of the Works it appears that such deviation will result in the most practical and economical completion of the Works without essentially deviating from the Plan of the Dwelling or the Specifications of the Dwelling or having a negative effect on the quality and finishing of the Works. The Seller may do so without the consent of the Purchaser.
27.4 Should any discrepancy arise from the Plan of the Dwelling and the Specifications of the Dwelling, the provisions of the Plan of Dwelling shall prevail.
27.5 The Purchaser irrevocably grants a power of attorney to the Seller to sign and submit the necessary plans and specifications to the local authority for its approval.
27.6 The placement of the Dwelling on the Erf shall be as per the recommendation of the Architect, whose decision will be final and binding on all Parties.
27.7 Any request for alterations and/or additions to the Plan of the Dwelling or the Specifications of the Dwelling by the Purchaser will be at the discretion of the Seller. Any amendments or alterations which are accepted by the Seller will be for the account of the Purchaser and the Purchaser shall pay therefore before the construction of alterations shall be commenced with.
27.8 Any alterations and/or variations required by the Purchaser shall at all times be subject to Local Authority approval and/or availability of material and should the Local Authority not approve thereof and or the material not be available, then the Purchase...
THE WORKS. THE WORKS. Drawings and Specifications
THE WORKS. 1.1 Subject to the terms and conditions set out below, National Grid shall carry out the following as set out in the Order and (if applicable) as varied in accordance with clause 7.1 below (the “Works”):
(a) alter the location of the service pipe to the premises specified in the Order (the “Premises”) and commission the altered service pipe; and/or
(b) remove and re-fix the meter installation at the Premises, provided that the existing meter installation at the premises is suitable for-fixing at the proposed location; and/or
(c) where National Grid has re-fixed the meter installation (where the Customer has requested it); the relocation and reconnection of the meter to the existing installation pipe provided that the length of pipe needed does not exceed the maximum length specified in the Order; and/or
(d) supply and fit a meter box (other than a built-in cavity meter box) at the Premises if required; and/or
(e) the permanent reinstatement of drives, paths and other surfaces disturbed during the Works; and/or
(f) carry out any other works included in the Order; and
(g) supply all necessary materials in respect of the above.

3.2 The Works shall be substantially in accordance with the House Plan and the Standard Specifications attached hereto, respectively marked, Annexure B and Annexure C, provided that the Builder shall be entitled in his discretion to deviate from the House Plan and Standard Specifications if, during the planning, building and construction of the Works if such deviation will result in the most practical and economical completion of the Works without materially deviating from the House Plan or Standard Specifications or having a negative effect on the quality and finishing of the Works. THE WORKS. 3.1 The Beneficiary shall carry out the Works in a timely manner, and in accordance with all relevant standards including health and safety, quality, and environmental standards as well as Applicable Laws.
3.2 The Beneficiary confirms that, in the event it elects to carry out or procure the Works, it is prepared to proceed with the Works on the terms set out in this Agreement including the Schedule.
3.3 The Beneficiary shall provide the Company with regular written progress updates in relation to the Works and in particular will update the Company on the following at least once per calendar month:
(a) information on the progress of the Works to date (including actual cost of the Works to date);
(b) a forecast of future cost of the Works up to the completion of the Works;
(c) a project plan showing the outstanding Works; and
(d) the latest estimated date for the completion of the Works and the associated risks and mitigation measures.
THE WORKS. 3.1 The Employer shall elect a finishing option contained in the Basic Specifications within 30 days after Signature Date, failing which the Developer reserves the right to elect a finishing option in the Basic Specifications on the Employer’s behalf, which election the Employer will be bound to.
3.2 The Contractor undertakes to execute the Works in a proper and workmanlike manner against payment of the Total Contract Price referred to in Clause 4 and 5 of this Agreement.
3.3 The Works shall be substantially in accordance with the Building Plan and Basic Specifications. The placement of the Works will be in accordance with the Building Plan.
3.4 Any material and/or Basic Specifications and/or Upgrade to Specifications will only serve as a guideline and the Contractor reserves the right to amend the Basic Specification and/or Upgrade to Specifications and/or material specified at his sole discretion if necessitated by availability, discontinuations or for any other reason. 3.5 All colour sanitary ware, carpets, tiles and face bricks, where applicable, shall be supplied at the risk of the Employer as the Contractor does not guarantee the colour, colour-match, texture,availability or quality thereof.
3.6 In the event of any discrepancy arising from the Building Plan and the Basic Specifications, the provisions of the Basic Specifications shall prevail.
3.7 The Employer irrevocably grants a power of attorney to the Contractor and/or Developer to sign and submit the necessary drawings and specifications to the Local Authority for its approval.
THE WORKS. 1.1 Subject to the terms and conditions set out below, Cadent shall carry out the following as set out in the Quotation and (if applicable) as varied in accordance with clauses 6.1 and 7.2 below (the “Works”):
(a) design, install, test, commission and connect to Cadent gas network a service pipe suitable for the premises specified in the Quotation (the “Premises”) and;
(b) supply and fit a meter box (other than a built-in cavity meter box) at the Premises; and
(c) the permanent reinstatement of drives, paths and other surfaces disturbed during the Works; and
(d) carry out any other works included in the Quotation; and
(e) supply all necessary materials in respect of the above.
