Documentation/Registration and Condition of Vessel. A current copy of the California Vessel Registration (D.M.V.) or United States Coast Guard Documentation must be on file in the Manager’s office, together with a current photograph of the Vessel. Vessel registration/documentation shall list the Vessel Owner(s) and all Company approved partners or equity owners. Vessel Owner shall tender to the Company on a yearly basis, with or without prior demand therefore, a true and correct copy of the Vessel’s then current state registration or federal documentation. Vessel Owner warrants that the Vessel is properly documented or registered pursuant to the laws of the United States and/or the State of California and that the Vessel is in compliance with all applicable U.S. Coast Guard safety regulations. Vessel Owner shall maintain the Vessel in a Seaworthy manner (as that term is defined in Exhibit B). Company shall be the sole judge of the adequacy of the Vessel’s Seaworthiness.

Documentation/Registration and Condition of Vessel. Owner shall keep his or her Vessel in a clean, well maintained and operable condition at all times during the term of this Agreement. The determination of adequacy of a Xxxxxx's appearance is within the sole discretion of the Marina. If equipped with an engine or motor, it must be operable and capable of producing sufficient way to make the Vessel maneuverable. If the Vessel is a sailboat without an engine, she must be equipped with sails, and her standing and running rigging must be seaworthy. Owner warrants that the Vessel is properly documented or registered pursuant to the laws of the United States and/or the State of California, or a foreign nation, and that the Vessel is in compliance with all applicable U.S. Coast Guard safety regulations. Owner shall maintain the Vessel's appearance, including regular cleaning, maintenance and replacement of all painted and varnished surfaces, all bright work, rigging, safety equipment and any other appurtenances of the Vessel. Should vessel’s appearance fail to be kept clean including but not limited to dust accumulation, in the Marina’s sole opinion, Xxxxxx shall notice Owner of the vessel’s need to be cleaned. If vessel is not cleaned to the satisfaction of the Marina, vessel shall be cleaned by the Marina or contractor of its choice. Cleaning charges will be the responsibility of the Owner and will be added to the monthly slip fees. Failure to pay such fees will result in termination of the wharfage agreement as described in sections 7 through 9.

Licensee warrants that the Vessel is properly documented or registered pursuant to the laws of the United States and/or the State of California and that the Vessel is in compliance with all applicable U.S. Coast Guard safety regulations. Licensee shall maintain the Vessel in a seaworthy, operable condition, and shall maintain the Vessel’s appearance; including regular cleaning, maintenance and replacement of all painted and varnished surfaces, all bright-work, rigging, safety equipment and any other appurtenances of the Vessel. County shall be the sole judge of the adequacy of the Vessel’s condition and maintenance. If equipped with an engine or motor, it must be operable and capable of producing sufficient way to make the Vessel maneuverable. If the Vessel is a sailboat without an engine, she must be equipped with sails, and her standing and running rigging must be seaworthy. The Vessel shall at all times be in compliance with the then applicable regulations, rules, orders, statutes and laws pertaining to water quality. The County may, at their own discretion require Licensee to provide proof of compliance by current inspection from the U.S. Coast Guard.

In order to verify and ensure the operational stability of Registry Services as well as to facilitate compliance checks on accredited registrars, Registry Operator will provide ICANN on a weekly basis (the day to be designated by ICANN) with up-to-date Registration Data as specified below. Data will include data committed as of 00:00:00 UTC on the day previous to the one designated for retrieval by ICANN.

  • Registration of Agreement The registration of License agreements should be done within 30 days of signing of agreement, the licensee/ lessee (registration fees, stamp duty etc to be fully borne by the licensee/lessee) and the duly registered documents to be submitted to Maha-Metro for records. Any amendment in the contract agreement, if required to be registered, shall also be registered within 30 days from the date of amendment and duly registered documents shall be submitted to Maha-Metro for record. In case the registration of the license/lease agreement /amendment is not done within the 30 days of signing of license/lease agreement/ amendment, it shall be treated as “Material Breach of Contract”. The Licensee will be given 30 days time to cure the defaults In case Licensee fail to remedify the default to the satisfaction of the Maha-Metro within the cure period, Maha-Metro may terminate the License agreement after expiry of cure period duly forfeiting the security deposit/ any other amount paid by Licensee.

  • Termination of Registration Rights The right of any Holder to request registration or inclusion of Registrable Securities in any registration pursuant to Subsections 2.1 or 2.2 shall terminate upon the earliest to occur of:
