DOI. The authority for the DOI to enter into this MOU includes section 307(b) of the Federal Land Policy and Management Act of 1976 (43 USC § 1737(b)), the ESA (16 U.S.C. § 1531et seq.), NEPA, the Migratory Bird Treaty Act (16 U.S.C. § 703 et seq.), the NPS Organic Act (16 U.S.C. §§ 1-3), the Indian Right-of-Way Act of 1948 (25 U.S.C. § 323 et seq.), the Act of June 17, 1902 (Reclamation Act), as amended and supplemented (43 U.S.C. § 391 et seq.), and Service First, §330, Pub. L. No. 106-291, as amended by §428, Pub. L. No. 109-54 and §418, Pub. L. No. 111-8.
