ACHP. The ACHP will be available to assist in resolving any issues regarding the coordination of the environmental reviews required for siting and permitting qualifying projects and to participate in consultation under Section 106 of the NHPA, as needed, in accordance with 36 CFR part 800 “Protection of Historic Properties.”
ACHP. The ACHP shall provide technical guidance, participate in dispute resolution, and monitor the effectiveness of this agreement, as appropriate.
ACHP. 1. ACHP will provide guidance and advisory information to resolve disputes that may occur during the implementation of this Agreement, pursuant to the Dispute Resolution process in Stipulation XII.
2. ACHP will advise USACE if it will participate in consultations to resolve adverse effects, pursuant to 36 CFR § 800.6(a)(1).
3. ACHP will participate in the annual reviews convened by USACE to review the effectiveness of this Agreement.
ACHP a. Should the Texas Historical Commission be an Applicant for FEMA assistance, SHPO will be responsible for following their internal protocols and procedures, Protocols and Procedures for Consultation on Historic Sites Division Projects, for consultation with FEMA. If for any reason FEMA or SHPO determine that SHPO review of an Undertaking may otherwise be an apparent or actual conflict of interest, ACHP will review the Undertaking in lieu of SHPO.
ACHP a. The ACHP will provide guidance and advisory information and will consult with FEMA and others, as appropriate, to resolve disputes or address public comments that may occur during the implementation of this Agreement.
b. The ACHP will provide information on preservation issues of concern, including consultation and policy guidance, within the declared disaster area.
c. The ACHP may identify ACHP staff to assist FEMA staff with its Section 106 responsibilities, and assign a disaster-specific liaison, as necessary, at FEMA’s request for specific projects.
ACHP. 1. The ACHP will participate in consultation to resolve Adverse Effects when determined appropriate by ACHP.
2. The ACHP will assist in resolving disputes among signatories of this Agreement, any affected Indian Tribe(s), any applicant, or any recipient.
ACHP. Issues relating to BLM’s findings of effect, resolution of adverse effects or their treatment, which cannot be resolved with BLM to the satisfaction of the disputing party(ies), may be referred to the ACHP for review and comment.
ACHP. ACHP shall review Project submittals according to the timeframes defined within this PA and participate in consultation, as requested by FRA.
ACHP a. The ACHP is responsible for reviewing project submittals and will participate in consultation according to the timeframes and communications defined in Stipulation I and otherwise stipulated within this Agreement.
b. The ACHP consults with and comments to agency officials on individual undertakings and programs that affect historic properties.
c. The ACHP will be responsible for providing technical guidance and participating in dispute resolution upon request pursuant to Stipulation XVII.
d. The ACHP has authority to execute, request to amend, and/or terminate this Agreement.
