Due Care. The Service Provider shall exercise due care and caution in providing the Services so that the City's ’s public and private property, including streets and parking areas, will be protected protected, and preserved. Except in the case of Service Provider’s negligence or willful misconduct, Service Provider shall not be liable for damages to pavement, curbing, or other driving surfaces, provided that Service Provider’s equipment is being operated within normal industry standards for the type of vehicles used and type of street material and construction of such city streets.
