Common use of During Construction Clause in Contracts

During Construction. a. Tenant Contractor’s work area (including storage) will be restricted to the Premises. No construction will be permitted in the enclosed Mall. Contractors must use the Premises as a staging area for all construction, with the exception of storefront and signs. No storage or office trailers will be allowed on the site without Landlord’s written permission. b. Certain instances may require Tenant’s Contractor and Landlord to enter other tenants’ premises to perform necessary underslab work, construction extending through levels above, etc. Arrangements for permission to enter other tenants’ premises must be made through Landlord. Such work must be performed at times when such other tenant’s operation will not be affected. All costs associated with said work, including security personnel, are Xxxxxx’s expense. c. Landlord’s structural elements other than floor slab may not be used for support of any Tenant construction or equipment including storefront grilles. d. All materials used for Tenant’s Work will be maintained at all times within the Premises. Under no circumstances will any portion of the enclosed Mall area be used to store Tenant’s or Tenant’s Contractor’s material, equipment or trash. Landlord reserves the right to clear the enclosed Mall area of any dirt or debris due to Tenant’s construction and back charge to Tenant without prior written notice. e. Tenant and Xxxxxx’s Contractor shall protect their work from damage and shall protect the work of other tenants from damage by Xxxxxx, Tenant’s Contractor and their employees and subcontractors. Landlord shall not be held responsible for damage done by other tenants or their contractors. f. Mall floors, neutral strips and Landlord’s bulkhead must be protected from damage by Xxxxxx’s construction. Any damage resulting from Xxxxxx’s construction will be rectified by Landlord at Xxxxxx’s expense. g. Any electricity needed to work in the Premises shall come from Tenant’s wiring within the Premises, not from Common Area outlets. h. Tenant’s HVAC equipment must utilize existing utility shafts for outside air intake and toilet room exhaust. Coordinate all work with Xxxxxxxx’s Representative. i. Elevators may be used as necessary for material deliveries, but must be scheduled for use through Landlord. j. Tenant shall pay for temporary electricity consumed during the construction of the Premises as metered by the existing meter. If the meter is removed or does not exist, the temporary electrical rate $0.25/s.f./month or a minimum of $500.00 per month shall be paid by Tenant until a meter is operational.

No storage or office trailers will be allowed on the site without Landlord’s Owner's written permission. b. Certain instances may require Tenant’s 's Contractor and Landlord Owner to enter other tenants’ Tenant's premises to perform necessary underslab work, construction extending through levels above, etc. Arrangements for permission to enter other tenants’ tenant's premises must be made through LandlordOwner's Representative. Such work must be performed at times when such other tenant’s 's operation will not be affected. All Tenant shall be responsible for any incurred costs associated with said work, including security personnel, are Xxxxxx’s expenseto accommodate access. c. Landlord’s Owner's structural elements other than floor slab may not be used for support of any Tenant construction or equipment including storefront grillesequipment, without Owner approval. d. All materials used for Tenant’s 's Work will be maintained at all times within the Premises. Under no circumstances will any portion of the enclosed Mall area can material, equipment or trash staging be used to store supported beyond Tenant’s 's demised premises Tenant's or Tenant’s 's Contractor’s 's material, equipment or trash. Landlord Owner reserves the right to clear the enclosed Mall Building area of any dirt or debris due to Tenant’s 's construction and charge back charge to Tenant without prior written noticetherefor. e. Tenant and Xxxxxx’s Tenant's Contractor shall protect their work from damage and shall protect the work of other tenants from damage by XxxxxxTenant, Tenant’s 's Contractor and their employees and subcontractors. Landlord Owner shall not be held responsible for damage done by other tenants or their contractors. f. Mall Building floors, neutral strips piers, storefronts and Landlord’s bulkhead Owner's soffit must be protected from damage by Xxxxxx’s Tenant's construction. Any damage resulting from Xxxxxx’s Tenant's construction will be rectified repaired by Landlord Owner at Xxxxxx’s Tenant's expense. g. Any electricity needed to for work in the Premises premises shall come from Tenant’s wiring within the Premises, not from Common Area outlets's electrical service. h. Tenant’s HVAC equipment must utilize existing utility shafts for outside air intake and toilet room exhaust. Coordinate all work with Xxxxxxxx’s Representative. i. Elevators may be used as necessary for material deliveries, but must be scheduled for use through Landlord. j.
