Common use of Duty Station Clause in Contracts

Duty Station. A. Neither an employee's duty station nor the employee shall be transferred unless such transfer is in the best interest of the State. Prior to approving any requests for involuntary transfers, the Director of the Division of Personnel shall request and consider the comments of the Union. Disputes arising over involuntary transfers shall enter the Grievance Procedure at Step Three, and if not resolved at that level, the parties agree to expedite arbitration. No such transfer shall be considered permanent until the arbitration step is completed. The provisions of this Section do not apply to office closures and office relocations.
