Duty to Cooperate and Remote Data Transmission. The licensee shall support the licensor in the performance of the contract to the extent necessary and free of charge, e.g. by providing employees, work rooms, hardware and software, data and telecommunications equipment. The licensee grants the licensor, or a company affiliated with it, access to the hardware and software, directly or by means of remote data transmission, in order to enable the licensor to fulfil his contractual services. In this context, the licensor shall safeguard the interests of the licensee, in particular also observe data protection and, if necessary, conclude agreements with the licensee on the processing of personal data on behalf of the licensee. If a technically easy access through telecommunication facilities is not possible or permitted, the licensee shall bear all adverse consequences (e.g. additional costs incurred as a result).
