Effect of a Suspension Notice served by Network Rail. Where Network Rail has served a Suspension Notice on the Train Operator: the Train Operator shall comply with any reasonable restrictions imposed on it by the Suspension Notice; the Suspension Notice shall remain in full force and effect in accordance with its terms until it has been revoked either in whole or in part by notice from Network Rail to the Train Operator under paragraph 2.5.4; service of the Suspension Notice shall not affect the Train Operator’s continuing obligation to pay the Track Charges; and service of the Suspension Notice shall not affect the Train Operator’s Firm Rights (as defined in Schedule 5) for the purpose of Part D of the Network Code.
Effect of a Suspension Notice served by Network Rail. Where Network Rail has served a Suspension Notice on the Freight Customer: the Freight Customer shall comply, and shall procure that each relevant Appointed Operator complies with any reasonable restrictions imposed on the Freight Customer and such Appointed Operator by the Suspension Notice; the Suspension Notice shall remain in full force and effect in accordance with its terms until it has been revoked either in whole or in part by notice from Network Rail to the Freight Customer under paragraph 2.5.4; service of the Suspension Notice shall not affect the Freight Customer's Firm Rights (as defined in Schedule 5) for the purpose of making an Access Proposal, Rolled Over Access Proposal or Train Operator Variation Request as defined in Part D of the Network Code; and to give effect to the Suspension Notice, in accordance with each relevant Operator Access Agreement Network Rail shall be entitled to serve a corresponding suspension notice on each Appointed Operator whose operation of the Services will be affected by the Suspension Notice.
