Effectiveness of Third Amendment. This Third Amendment shall be effective and become of full force and effect only upon receipt by Lessor of insurance binders or certificates in a form reasonably satisfactory to Lessor evidencing the maintenance by Lessee of all policies of insurance required to be maintained pursuant to Paragraph 18 of the Lease.

(“Delphix”) and Landlord, in a form acceptable to Landlord, in its sole discretion, whereby Delphix agrees to terminate its lease with respect to the Expansion Premises prior to the expiration date of the lease.
