The 'Eligible Claimants' clause defines who is permitted to make a claim under the agreement or policy. Eligible Claimants. (A) Only Eligible Claimants may participate in the Program. “Eligible Claimant” means all claimants (or their personal representatives) who: (a) have cases filed, as of the Execution Date, in (i) the MDL Court, (ii) any Other Federal Court Proceeding; or (iii) any State Court Proceeding, in each case alleging (in a complaint, in a Plaintiff Fact Sheet, or in both) a Gallbladder Injury (either alone or in combination with some other injury) resulting from the use of a DCOC; or (b) file and serve a case on or before March 25, 2013 (i.e., the Filing Deadline) in the MDL Court, any other federal court, or any state court, in each case alleging (in a complaint, in a Plaintiff Fact Sheet, or in both) a Gallbladder Injury resulting from the use of a DCOC, together with a Declaration of Counsel, contained in Appendix G.
Eligible Claimants. 4.1. To be an Eligible Claimant under this Agreement, a claimant must be a member of the Resident Subclass or the Non-Resident Subclass of the Class Action.
4.2. A member of the Resident Subclass is automatically an Eligible Claimant unless she registers to opt-out of the Class Action on or before the Registration Deadline. To do so she must submit the Opt-Out Form to Class Counsel postmarked on or before the Registration Deadline.
4.3. A member of the Non-Resident Subclass who wishes to participate in the Settlement must register to do so on or before the Registration Deadline. To do so she must submit the Registration/Opt-In Form to Class Counsel postmarked on or before the Registration Deadline.
Eligible Claimants. The Eligible Claimants:
(a) must keep this agreement and related negotiations and documents confidential and not disclose any of its terms without first obtaining the Holder’ prior written consent (which may not be unreasonably withheld); and
(b) may disclose this agreement to their advisers and consultants and to potential purchasers of the Land, provided the potential purchasers agree to keep this agreement confidential on the same terms as this clause.
Eligible Claimants a) Only those Class Members who are determined to be an Eligible Claimant by the Claims Administrator shall be eligible to receive Distribution Payments under this Settlement Agreement.
Eligible Claimants. Any of the remaining unsettled plaintiffs who filed one of five pending lawsuits against Ohio State as of July 29, 2020, pursuant to the Court’s April 17, 2020 Order directing the filing of consolidated complaints, may be eligible to participate in the Program, provided he meets the below criteria and submits information sufficient to allow ▇▇. ▇▇▇▇▇▇▇▇▇ to reasonably confirm all of the following:
