Common use of EMERGENCY PROTECTIVE MEASURES Clause in Contracts

EMERGENCY PROTECTIVE MEASURES. (Category B) – are those prudent actions taken by a community before, during and following a disaster to warn residents, reduce the disaster damage, ensure the continuation of essential public services, and protect lives and public health or safety. Immediate rescue and salvage operations conducted to preserve life and property are exempt from the provisions of Section 106 (36 C.F.R. § 800.12.d). This list includes a number of emergency actions that do not have the potential to cause effects to historic properties, per 36 C.F.R. § 800.3(a)(1). It also includes Undertakings that will not disturb previously undisturbed ground or that involve historic structures but meet specific conditions.
