Common use of Employee Initiated Transfer Clause in Contracts

Employee Initiated Transfer. An employee desiring to transfer to a vacant position shall, within five (5) days after the vacancy has been posted, file a written request for transfer in the Personnel Office. All unit members who request a transfer shall be considered, and if selected, the unit member shall be transferred. Final authorization for all transfers will be made by the Superintendent, or his/her designee, after receiving the recommendation of the Supervisor responsible for the particular area of the assignment and the Superintendent, or his/her designee. EMPLOYER-INITIATED TRANSFER: An employee may be transferred by the Superintendent, or his/her designee, for reasons other than punitive, based upon the justifiable needs and best interests of the District provided that such transfer shall not result in the loss of pay or benefits to the employee. The employee shall be given a minimum of five (5) workdays' notice prior to the effective transfer date and, if requested, a written explanation shall be given the employee.
