Employee Representatives & Their Rights. In this clause the expression "delegate" means an Employee who is elected by Employees as the representative of Employees at the workplace or within the Company. a) The Parties acknowledge it is a right, but not a requirement, of Employees to elect a delegate (themselves an Employee) who shall be recognised as an authorised representative of the Employees. b) A delegate shall have the right to approach or be approached by any Employee of the Company who works on the same site to discuss workplace matters during normal work hours, provided such discussions do not interfere with the performance of work. c) Where a delegate seeks to investigate a suspected breach of this Agreement and has been requested to do so by a particular Employee, they will be required to fulfil the requirements of the Act as it applies to the right of entry for industrial representatives. d) There shall be no deduction to wages where a delegate is required to attend any grievance/dispute procedure or other court/tribunal proceedings relating to workplace matters impacting on Company Employees. e) The Company shall permit a notice board to be erected in an agreed location to facilitate communication between Employees and/or their Employee representatives. f) The Company shall permit an Employee representative reasonable access to phone, fax or other communication means in order to facilitate the provisions of this clause.
