EMPLOYEE RIGHTS & DISCIPLINE. A. No seniority employee may be disciplined, suspended or discharged without just cause and due process. B. Each employee shall have the right, upon request, to review the contents of their personnel file. The employee may request a representative of the Association to participate in the review. C. Any disciplinary action taken against an employee shall be appropriate to the behavior, which precipitated the disciplinary action, and all written disciplinary action will be documented as such. D. An employee shall at all times be entitled to have a representative of the Association present when being investigated, reprimanded, warned or otherwise disciplined for any infraction of discipline or delinquency in job performance. When a request for representation is made, no action shall be taken with respect to the employee until the Association is present. (This should be part of the record and be signed by the employee.) E. The private and personal life of any employee is not within the concern of the Board unless the employee’s actions reflect detrimentally on the school system. F. No lie detector device shall be used in an investigation of any employee. G. Nothing in this agreement shall deny or restrict any individual rights provided under Michigan or United States Law.
