Employment of Chief Executive Officer. At a reasonable time prior to estimated start-up date of the Company’s operations, the Board shall select, employ, and fix the compensation of a CEO of the Company. The CEO position shall be an officer of the Company. The CEO shall perform the functions of and shall also carry the title of Chief Manager of the Company. The CEO may be a member of the Board. The CEO shall have responsibility for all administrative and operational aspects of the Company and shall have responsibility for hiring and supervising all employees, as determined and established by the Board, and shall perform such other duties that may be assigned by the Board.
Employment of Chief Executive Officer. The Borrower shall continue to retain Xxxxxx X. Xxxxx, or other person reasonably satisfactory to Agent, as chief executive officer of the Borrower on terms and conditions reasonably acceptable to Agent.
