Common use of Engagement of Owner’s Design-Build Consultant Clause in Contracts

Engagement of Owner’s Design-Build Consultant. Owner may engage an Owner’s Design- Build Consultant to perform some of Owner’s duties described in the Contract Documents, in which case Owner shall cause Owner’s Design-Build Consultant to perform such duties in accordance with the terms of the Contract Documents. Owner shall notify Design-Builder of: (a) the identity of Owner’s Design-Build Consultant; (b) the name and title of the person who shall be authorized to act on behalf of Owner’s Design-Build Consultant and serve as the primary contact between Design-Builder and Owner’s Design-Build Consultant in connection with the Contract Documents; and (c) the duties to be performed by Owner’s Design-Build Consultant. If Owner does not engage an Owner’s Design-Build Consultant, or discharges Owner’s Design-Build Consultant after written notification to Design-Builder, then all references herein to Owner’s Design-Build Consultant shall be deemed to refer to Owner.
