Engagement of third parties or subcontractors. 5.1 The Controller hereby gives the Processor permission to use a third party for the processing of personal data on the basis of this Processing Agreement, with due observance of the applicable privacy legislation.
5.2 At the request of the Controller, the Processor will inform the Controller as soon as possible about the third parties it has engaged. Controller has the right to object to any third parties engaged by Processor. If the Controller objects to third parties engaged by the Processor, the Parties will consult each other to find a solution.
5.3 The Processor will in any case ensure that these third parties assume the same obligations in writing as agreed between Controller and Processor. The Processor guarantees the correct compliance with these obligations by these third parties and, in the event of errors of these third parties, is itself liable to the Controller for all damage as if he had committed the error(s) himself.
Engagement of third parties or subcontractors. 1. Processor shall not engage any other processor (subprocessor) without the written consent of Controller.
2. Controller has the right to object to the engagement of a subprocessor. This objection must be submitted in writing, providing an argumentation, within two weeks.
3. Processor shall unconditionally ensure that those third parties accept in writing to take over the same obligations as those agreed between Controller and Processor. Processor guarantees correct compliance with these obligations by these third parties.
Engagement of third parties or subcontractors. 5.1 The Client hereby gives digitalAudience general permission to engage a third party in the processing of personal data pursuant to this Processing Agreement, with due observance of the applicable privacy legislation.
5.2 At the Client's explicit request, digitalAudience will notify the Client of third parties it has engaged. The Client has the right to object to any third party engaged by digitalAudience. If the Client objects to third parties engaged by digitalAudience, the Parties will consult in order to reach a solution.
5.3 digitalAudience will ensure that these third parties undertake the same obligations in writing as those agreed between the Client and digitalAudience. digitalAudience guarantees proper compliance with these obligations by these third parties and will itself be liable to the Client in the event of errors by these third parties, as if it had committed the error(s) itself.
Engagement of third parties or subcontractors. 5.1. The Supplier may, within the framework of this Sub-Processing Agreement, engage a third party, without the prior consent of Reseller, under the condition that the Reseller may prohibit the engagement of third parties if there are reasonable grounds to justify such a prohibition.
5.2. The Supplier shall ensure that these third parties are bound by the same obligations in writing as are agreed between the Supplier and the Reseller.
Engagement of third parties or subcontractors. The Data Importer is not permitted to make use of third parties, among which subcontractors and sub-processors of the sub-contractors, within the scope of the Agreement without the Data Exporter’s prior written permission; such permission may be subject of further conditions. The Data Importer will in any case ensure that these third parties undertake in writing the same obligations as agreed between the Data Exporter and the Data Importer. The Data Importer guarantees proper compliance with these obligations by these third parties and, in the event of any errors committed by these third parties, will be liable for any damage and/or loss as if the Data Importer itself had committed the error(s). The Data Importer indemnifies the Data Exporter against any claims in this respect.
