• Despite anything else in this Agreement, the Trader is entitled to be indemnified by the Distributor as set out in section 46A of the Consumer Guarantees Act 1993.

• Except for any liabilityarising from the FairTrading Act 1986 or Consumer Guarantees Act 1993, under no circumstances will the College be liable to the student or the applicant(s) or any other person for indirect or consequential loss or damage of any kind(including loss of profits).

Consumer Guarantees means the basic set of guarantees under the Australian Consumer Law available to consumers who purchase goods and services from Australian businesses.
