Exclusion of legislation. Any statutory restrictions (other than mandatory restrictions) on any right of the Secured Party, a Receiver or an Attorney to lease or otherwise deal with the Secured Property do not apply to the rights of those persons under this Deed.
Exclusion of legislation. (a) The provisions implied in mortgages by any statute are for the purposes of this Deed negative or varied only so far as they are inconsistent with the provisions of this Deed and are otherwise varied so as to become consistent with this Deed.
(b) Any statutory restrictions (other than mandatory restrictions) on any right of the Secured Party, a Receiver or an Attorney to lease or otherwise deal with the Secured Property do not apply to the rights of those persons under this Deed.
Exclusion of legislation. A person who is not a Party to this Agreement may not enforce any of its terms under the Contracts (Rights of Third Parties) Xxx 0000.
Exclusion of legislation. Any legislation or Law that adversely affects an obligation of a Party, or the exercise of any right or remedy, under or relating to this Contract is excluded to the full extent permitted by Law.
Exclusion of legislation. The following provisions of the Trustee Act do not apply to the Trustee and the Trust:
(a) subsection 17(3) does not apply to the terms of sale of any land by the Trustee; and
(b) subsection 27(4) does not apply to the costs of any audit of the accounts of the Trustee or the Fund.
Exclusion of legislation. To the extent permitted by law, all legislation which (directly or indirectly):
(a) lessens, varies or affects any obligation of the Mortgagor under this Deed; or
(b) delays, prevents or prejudicially affects the exercise by the Mortgagee or any Receiver of any right, power or remedy under this Deed, is excluded from this Deed.
Exclusion of legislation. This Contract is entered into under the PFI. This Contract is excluded from Part II of the Housing Grants, Construction and Regeneration Act 1996 by operation of paragraph 4 of the Construction Contracts (England and Wales) Exclusion Order 1998. The Contractor acknowledges that the operation of the Housing Grants, Construction and Regeneration Act 1996 upon any Ancillary Document shall not affect the Parties’ rights or obligations under this Contract.
Exclusion of legislation. (a) The provisions implied in securities by any statute will for the purposes of this document be negatived or varied only so far as they are inconsistent with the provisions of this document and are otherwise varied so as to become consistent with this document.
(b) Any statutory restrictions (other than mandatory restrictions) upon any right of the creditor, receiver or attorney to deal with the secured property will not apply to the rights of those persons under this document.
Exclusion of legislation. 4.1 No term of this Contract is enforceable under the Contracts (Rights of Third Parties) Act 1999 by a person who is not a party to this Contract. Notwithstanding anything to the contrary elsewhere in the Contract, no right is granted to any person who is not a party to the Contract to enforce any term of the Contract in his own right and the Parties declare that they have no intention to grant any such right.
4.2 This Contract is entered into under the Private Finance Initiative. This Contract is excluded from Part II of the Housing Grants, Construction and Regeneration Act 1996 by operation of paragraph 4 of the Construction Contracts (England and Wales) Exclusion Order 1998. The Contractor acknowledges that the operation of the Housing Grants, Construction and Regeneration Act 1996 upon any Project Document shall not affect the Parties' rights or obligations under this Contract.
Exclusion of legislation. 42.1. No term of this Agreement is enforceable under the Contracts (Rights of Third Parties) Act 1999 by a person who is not a party to this Agreement.
