Execution of operations. When PCSIL executes a payment order in accordance with the unique identifier provided (International Bank Account Number or “IBAN”), the order will be considered correctly executed. In the event that the unique IBAN identifier provided by the User is incorrect, PCSIL will not be responsible for the non- execution or faulty execution of the payment transaction. Notwithstanding this, PCSIL will use reasonable efforts to try to recover the funds from the payment transaction. The fact that the User provides additional information to PCSIL in their payment order will not modify the liability regime indicated in this paragraph. PCSIL will be responsible for the execution of the operations as long as they are under its control, that is: a) the operations initiated by the payer or provider of initiation of payments, until the moment in which the amount is credited to the account of the payment service provider of the beneficiary; and

Execution of operations via Open interface or via Direct interface consists of the same stages as using NetBank directly except that when using Open interface E-User, first, enters into platform of Account information service provider and/or Payment initiation service provider where E-User is identified with Security Keys and when using the Direct interface E- User is identified with Security Keys when entering Bank's electronic channel.

Execution of operations. 7.1 SWAG shall execute the Transactions indicated by the Customer within the limits and in accordance with the provisions contained in the Agreement; however, if a justified reason exists, it may refuse to take on the task of executing the Transactions, giving timely notice to the Customer, including by means of remote communication techniques. 7.2 If the Customer does not provide particular instructions, SWAG determines how to execute the Transactions with diligence appropriate to its professional condition and otherwise taking into account the interests of the Customer and the nature of the Transactions. 7.3 The Client may revoke the assignment given to SWAG, as long as the assignment itself has not had a principle of execution, consistent with the manner of such execution.

  • TRANSFER OF OPERATIONS Purchaser shall be entitled to immediate possession of, and to exercise all rights arising under, the Assets from and after the time that the Restaurants open for business on the Closing Date, and operation of the Restaurants shall transfer at such time (the "Effective Time"). Pursuant to the Corporate Accountability for Tax Expenditures Act, 20 ILCS 715, et seq., a discontinuance of operations at the Project during the five-year period after the beginning of the first Taxable Year for which the Department issues a Certificate of Verification shall result in all Credits taken by the Company during such five-year period being deemed Wrongfully Exempted Illinois State Income Taxes and shall subject said Wrongfully Exempted Illinois State Income Taxes to the forfeiture provisions of Section VIII.D hereof. 2. Pursuant to Section 5-65 of the Act, discontinuance by the Company of operations at the Project during the term of this Agreement with the intent to terminate operations in the State of Illinois shall result in all Credits taken by the Company being deemed Wrongfully Exempted Illinois State Income Taxes and shall subject said Wrongfully Exempted Illinois State Income Taxes to the forfeiture provisions of Section VIII.D hereof.

  • Conduct of Operations The Board of Directors and the General Partner shall use commercially reasonable efforts to conduct the business of the Partnership and its Affiliates in a manner that does not require a holder of Common Units to file a tax return in any jurisdiction with which the holder has no contact other than through ownership of Common Units.
