Exemption from redundancy clause. (a) This clause shall not apply: (i) where termination of employment is a consequence of malingering, inefficiency, neglect of duty, misconduct or refusing duty, viz. conduct that justifies summary dismissal; (ii) to Employees employed on a casual basis, provided that the Employer shall not employ a casual worker for the purpose of avoiding redundancy pay; (iii) to Employees engaged for a specific period of time for a specific task or tasks; (iv) to transferring Employees under the transfer of business provisions of the FWA.
