Exigences du programme. 2.1 Utilisation du programme (a) que l’institution est autorisée à utiliser le programme uniquement conformément aux xxxx et réglementations applicables et aux directives d’utilisation du programme contenues dans le guide du programme d’enregistrement d’appareils, modifiées parfois par Apple et disponibles à la page xxxx://xxx.xxxxx.xxx/iphone/business/it/management.html ; (b) que l’institution n’est pas autorisée à utiliser le programme (ou quelque partie de ce dernier) pour des activités illicites, inappropriées ou illégales ; (c) que l’institution est autorisée à utiliser le programme uniquement pour gérer des appareils autorisés pour une utilisation par des utilisateurs autorisés et non pour un déploiement général à des tierces parties et que l’institution est responsable de toute utilisation des appareils autorisés par ses utilisateurs autorisés ; (d) que l’institution obtient tous les droits et accords nécessaires de ses utilisateurs autorisés pour déployer ses appareils autorisés comme permis par le présent contrat ; (e) que l’institution peut ajouter des administrateurs au programme, mais uniquement si ces personnes sont des employés ou des contractuels de l’institution ou des fournisseurs de services agissant au nom de celle-ci et que l’institution peut les ajouter uniquement à des fins de gestion de compte ; et (f) que l’institution est autorisée à utiliser le programme uniquement à des fins de technologie de l’information internes et n’est pas autorisée à fournir à des tierces parties un produit ou un service intégrant ou utilisant des services ou des informations fournies par le programme ou à utiliser le programme d’une quelconque manière, sauf indication contraire d’Apple par écrit. 2.2 Aucune autre utilisation autorisée 2.3 Utilisation de jeton serveur 2.4 Dispositions du contrat de licence d’utilisateur final (a) les représentants autorisés de l’institution doivent accepter les dispositions du contrat de licence d’utilisateur final pour le Logiciel Apple sur le portail web du programme avant de mettre à disposition des utilisateurs autorisés les appareils autorisés exécutant le Logiciel Apple ; (b) si les dispositions du contrat de licence d’utilisateur final du Logiciel Apple ont été modifiées, l’institution accepte que ses représentants autorisés retournent sur le portail web du programme et acceptent lesdites conditions sans délai lorsqu’elle en est notifiée par Apple afin de continuer à utiliser le programme ; l’institution reconnaît qu...

  • Client Categorisation 4.1. The client understands and accepts that each category of Clients has its individual level of regulative protection acknowledging that Retail Clients have the highest level of protection whereas Professional Clients and Eligible Counterparties are considered to be more experienced, informed, skilled and able to estimate their risk, therefore are provided with a lower level of protection. 4.2. The Company will treat the Client as a Retail Client, Professional Client or Eligible Counterparty, depending on how the Client completes the Application Form and according to the method of categorisation as this method is explained under the title “Client Categorisation” (Appendix II), and by accepting this Agreement the Client accepts application of such method. 4.3. The Client accepts that when categorising the Client and dealing with him, the Company will rely on the accuracy, completeness and correctness of the information provided by the Client in his Application Form and the Client has the responsibility to immediately notify the Company in writing if such information changes. 4.4. The Company has the right to review the Client’s Categorisation and change his Categorisation if this is deemed necessary (subject to Applicable Laws).

  • Programme 13.1 Within the time stated in the Contract Data, the Contractor shall submit to the Engineer for approval a Programme showing the general methods, arrangements,' order and timing for all the activities for the construction of works. 13.2 The program shall be supported with all the details regarding key personnel, equipment and machinery proposed to be deployed on the works for its execution. The contractor shall submit the list of equipment and machinery being brought to site, the list of key personnel being deployed, the list of machinery/equipment being placed in field laboratory and the location of field laboratory along with the Programme.

  • DOMICILIUM CITANDI ET EXECUTANDI 37.1 The Parties and the Participants choose as their domicilia citandi et executandi for all purposes under this Trust Deed, whether in respect of court process, notices or other documents or communications of whatsoever nature, the following addresses and fax numbers and email addresses – 37.1.1 The Company and the Trustees: Harmony Xxxxxx Xxxx, xxx Xxxx Xxxx Xxxx xxx Xxxx Xxxxxx, Randfontein, 1759; Telefax: +00 (0)00 000-0000; email: xxxxx.xxxxxxxxx@xxxxxxx.xx.xx; 37.1.2 Each Participant: the address, telefax number and email address (if any) notified by the Participant to the Company or the Trustees in writing from time to time. 37.2 Any notice or communication required or permitted to be given in terms of this Trust Deed shall be valid and effective only if in writing and, unless otherwise provided by the Trustees, it shall be competent to give notice by telefax and e-mail. 37.3 Any of the parties may by notice to the other parties change the physical address chosen as its domicilium citandi et executandi vis-à-vis that party to another physical address in South Africa or its telefax number, provided that the change shall become effective vis-à-vis that addressee on the fourth business day from the deemed receipt of the notice by the addressee. 37.4 Any notice to a party – 37.4.1 sent by prepaid registered post (by airmail if appropriate) in a correctly addressed envelope to it at its domicilium citandi et executandi shall be deemed to have been received on the 10th (tenth) business day after posting (unless the contrary is proved); 37.4.2 delivered by hand to a responsible person during ordinary business hours at its domicilium citandi et executandi shall be deemed to have been received on the day of delivery; or 37.4.3 sent by telefax or email to its chosen telefax number or email address referred to in clause 37.1.1, shall be deemed to have been received on the date of dispatch (unless the contrary is proved). 37.5 Notwithstanding anything to the contrary herein contained a written notice or communication actually received by a party shall be an adequate written notice or communication to it notwithstanding that it was not sent to or delivered at its chosen domicilium citandi et executandi.
