Existing Deeds of Trust. The beneficiary under any existing deed of trust affecting the building shall provide a written agreement to tenant in the form of Document I in the Supplemental Lease Documents delivered to Landlord concurrently with this Lease Agreement within thirty (30) days after the execution of this Lease Agreement.
Existing Deeds of Trust. The Premises and this Lease are subject and subordinate to the terms of that certain [Construction Deed of Trust with Absolute Assignment of Leases and Rents, Security Agreement and Fixture Filing,] in which Tenant is the trustor and (“Existing Lender”), is the beneficiary, and recorded , 201_, at Document Number 201_- records of the Maricopa County, Arizona (the “Existing Deed of Trust”), securing a construction and permanent loan on the Premises, and to any amendments, modifications, renewals and extensions thereof. The notices and protections given to a Leasehold Mortgagee in this Lease shall also be given and extended by the Landlord to the Existing Lender as beneficiary under the Existing Deed of Trust (as amended and converted to a Leasehold Mortgage). Existing Lender is recognized by the parties as a third-party beneficiary of those portions of this Lease which require notices to and give protections to a Leasehold Mortgagee, until Existing Lender gives written notice to Landlord that its Leasehold Mortgage is satisfied or that its Leasehold Mortgage is released of record as a lien against all portions of the Premises.
Existing Deeds of Trust. The beneficiary under any existing deed of trust affecting the Building shall provide a written agreement to Tenant in the form of Exhibit E attached hereto, within 30 days after the execution of this Lease.
Existing Deeds of Trust. Landlord represents and warrants to Tenant that as of the date of execution of this Lease, there are no deeds of trust or ground leases encumbering the Phase IV Real Property or any portion thereof.
Existing Deeds of Trust. C. In connection with the Loan, the Initial Borrowers, KBSIII 000 XXXXX XXXXXX, XXX, a Delaware limited liability company (the "Released Borrower"), the Park Place Borrower (by its execution of that certain Assumption and Joinder Agreement dated as of June 19, 2015 by and between Park Place Borrower, Initial Borrowers, Agent and the Lenders) and the Additional Borrower (by executing the Joinder (as defined below)), executed in favor of Agent and the Lenders that certain Amended and Restated Unsecured Environmental Indemnity dated as of March 10, 2014 (the "Environmental Indemnity") and the other "Loan Documents", as such term is defined in the Loan Agreement.
