Expansion and Effective Date. A. Effective as of the date that this Second Amendment is executed and delivered by both parties (the “Expansion Effective Date”), the Premises, as defined in the Lease, is increased from 11,225 rentable square feet on the 2nd and 3rd floors to 14,925 rentable square feet on the 2nd and 3rd floor by the addition of the Expansion Space, and from and after the Expansion Effective Date, the Original Premises and the Expansion Space, collectively, shall be deemed the Premises, as defined in the Lease. The term of the Lease for the Expansion Space shall commence on the Expansion Effective Date and end on December 31, 2009 (the “Termination Date”). The Expansion Space is subject to all the terms and conditions of the Lease except as expressly modified herein, except that Tenant shall not be entitled to receive, with respect to the Expansion Space, any allowances, abatements or other financial concessions granted with respect to the Original Premises, as set forth in Exhibit C to the Lease, Section III of the First Amendment and Exhibit B to the First Amendment.
B. The Expansion Effective Date shall be delayed to the extent that Landlord fails to deliver possession of the Expansion Space for any reason, including but not limited to, holding over by prior occupants. Any such delay in the Expansion Effective Date shall not subject Landlord to any liability for any loss or damage resulting therefrom. If the Expansion Effective Date is delayed, the Termination Date under the Lease shall not be similarly extended.
Expansion and Effective Date. 3.1 Effective as of the Expansion Effective Date (as defined below), the Expansion Space shall be deemed part of the Premises, as defined in the Lease, and from and after the Expansion Effective Date, the Remaining Portion of the Original Premises and the Expansion Space, collectively, shall be deemed the Premises, as defined in the Lease. As of the Expansion Effective Date, the Premises, as defined in the Lease, shall be deemed to contain 10,282 square feet of Rentable Area in the Building, comprised of the Remaining Portion of Original Premises and the Expansion Space. The Term for the Expansion Space shall commence on the Expansion Effective Date and end on the Extended Termination Date (defined in Section 4 below). Notwithstanding anything to the contrary contained in the Lease, as amended hereby, the Expansion Space shall be used by Tenant solely for the storage and operation of Tenant’s data equipment and racks and for no other purpose whatsoever. The Expansion Space is subject to all the terms and conditions of the Lease except as expressly modified herein, except that, notwithstanding anything to the contrary contained in the Lease, as amended hereby, no janitorial service or climate control (i.e., heating, ventilation and air conditioning service) will be supplied to the Expansion Space and Tenant shall not be entitled to receive any allowances, abatements or other financial concessions granted with respect to the Original Premises unless such concessions are expressly provided for herein with respect to the Expansion Space.
3.2 The Expansion Effective Date shall be the date upon which the Side Light Work (as defined in Exhibit C attached hereto) in the Expansion Space has been substantially completed; provided, however, that if Landlord shall be delayed in substantially completing the Side Light Work as a result of the occurrence of a Tenant Delay (defined below), then, for purposes of determining the Expansion Effective Date, the date of substantial completion shall be deemed to be the day that said Side Light Work would have been substantially completed
Expansion and Effective Date. Effective as of November 1st, 2006 (“Expansion Effective Date”), the Premises is increased from 53,762 rentable square feet on the third, fourth, seventh, twelfth, sixteenth, seventeenth and nineteenth floors to 57,194 rentable square feet on the third, fourth, seventh, eighth, twelfth, sixteenth, seventeenth and nineteenth floors by the addition of the Expansion Space. The lease term for the Expansion Space shall commence on the Expansion Effective Date and end on August 31st, 2009 (the “Termination Date”). The Expansion Space is subject to all the terms and conditions of the Lease except as expressly modified herein and except that Tenant shall not be entitled to receive any allowances, abatement or other financial concession granted with respect to the Premises unless such concessions are expressly provided for herein with respect to the Expansion Space.
Expansion and Effective Date. Effective as of November 1, 2009 (the “Expansion Effective Date”), the Premises, as defined in the Lease, is increased from 99,041 rentable square feet on the 1st floor to 110,041 rentable square feet on the 1st floor and the Mezzanine level by the addition of the Expansion Space, and from and after the Expansion Effective Date, the Original Premises and the Expansion Space, collectively, shall be deemed the Premises, as defined in the Lease. The Term for the Expansion Space shall commence on the Expansion Effective Date and end on the Expiration Date (i.e., December 31, 2012). The Expansion Space is subject to all the terms and conditions of the Lease except as expressly modified herein and Tenant shall not be entitled to receive any allowances, abatements or other financial concessions granted with respect to the Original Premises or the Expansion Space, except as set forth herein or in the Lease.

Effective as of the Expansion Effective Date (defined below), the Premises, as defined in the Lease, is increased from 42,470 rentable square feet on the second (2nd ) and third (3rd) floors of the Building to 49,750 rentable square feet on the second (2nd ) and third (3rd) floors of the Building by the addition of the Expansion Space. From and after the Expansion Effective Date, references in the Lease to the Premises shall be deemed to refer to the Original Premises and the Expansion Space, collectively. The Term for the Expansion Space shall commence on the Expansion Effective Date, and end on the expiration of the Term, which, unless sooner terminated in accordance with the Lease, shall mean September 30, 2019 (“Termination Date”). Landlord shall deliver the Expansion Space to Tenant with the utility service to same separately metered and in good working condition. The Expansion Space is subject to all the terms and conditions of the Lease (including, without limitation, the Right of First Offer, as set forth in Section VII of the Third Amendment), except as expressly modified herein, and except that Tenant shall not be entitled to receive any allowances, abatements or other financial concessions granted with respect to the Original Premises unless such concessions are expressly provided for herein with respect to the Expansion Space.

The Term for the Expansion Space shall commence on the Expansion Effective Date and end on the Termination Date. The Expansion Space is subject to all the terms and conditions of the Lease except as expressly modified herein and except that Tenant shall not be entitled to receive any allowances, abatements or other financial concessions granted with respect to the Original Premises unless such concessions are expressly provided for herein with respect to the Expansion Space.

Effective as of October 1, 2002 (the "Expansion Effective Date"), the Premises, as defined in the Lease, is increased from 1,000 rentable square feet on the 31st floor to 2,000 rentable square feet on the 31st floor by the addition of the Expansion Space, and from and after the Expansion Effective Date, the Original Premises and the Expansion Space, collectively, shall be deemed the Premises, as defined in the Lease. The Lease Term for the Expansion Space shall commence on the Expansion Effective Date and end on the Termination Date (i.e., May 31, 2014). The Expansion Space is subject to all the terms and conditions of the Lease except as expressly modified herein and except the Tenant shall not be entitled to receive any allowances, abatements or other financial concessions granted with respect to the Original Premises unless such concessions are expressly provided for herein with respect to the Expansion Space.
B. The Term for the Expansion Space shall commence on the Expansion Effective Date and end on the Termination Date. The Expansion Space is subject to all the terms and conditions of the Lease except as expressly modified herein and except that Tenant shall not be entitled to receive any allowances, abatements or other financial concessions granted with respect to the Existing Premises unless such concessions are expressly provided for herein with respect to the Expansion Space.
Expansion and Effective Date. A. The Term for the Expansion Space shall commence (“Expansion Effective Date”) on the earlier of (a) the date the Expansion Space is deemed ready for occupancy pursuant to Section I.B below, or (b) the date Tenant commences its business activities within the Expansion Space, and shall expire upon the Extended Expiration Date (hereinafter defined). The Expansion Effective Date is estimated to be February 1, 2019 (“Estimated Expansion Effective Date”). Promptly following request by Landlord, the parties shall memorialize on a form provided by Landlord (the “Expansion Effective Date Memorandum”) the actual Expansion Effective Date; should Tenant fail to execute and return the Expansion Effective Date Memorandum to Landlord within five (5) business days (or provide specific written objections thereto within that period), then Landlord’s determination of the Expansion Effective Date as set forth in the Expansion Effective Date Memorandum shall be conclusive. Effective as of the Expansion Effective Date, the Premises, as defined in the Lease, shall be increased from 11,173 rentable square feet to 14,816 rentable square feet by the addition of the Expansion Space.
Expansion and Effective Date. From and after the Expansion Effective Date, references in the Lease to the Premises shall be deemed to refer to the Original Premises and the Additional Expansion Space, collectively. The Term for the Additional Expansion Space shall commence on the Expansion Effective Date, and end on the expiration of the Term, which, unless sooner terminated in accordance with the Lease, shall mean September 30, 2019 (“Termination Date”). The Additional Expansion Space is subject to all the terms and conditions of the Lease (including, without limitation, the Right of First Offer, as set forth in Section VII of the Third Amendment), except as expressly modified herein, and except that Tenant shall not be entitled to receive any allowances, abatements or other financial concessions granted with respect to the Original Premises unless such concessions are expressly provided for herein with respect to the Additional Expansion Space.
