Facilities Occupancy Requirement. The School acknowledges that its facility must meet all educational occupancy standards required by applicable New Mexico Construction Codesxxxiii. The School’s facilities shall be certified for occupancy as a public school prior to commencing operations in the new building, including the approval of the director or designee of the New Mexico Public Schools Facilities Authority (“PSFA”)xxxiv. The School further acknowledges that if it is renewed on or after July 1, 2015, that its facilities must meet the requirements as set forth in Subsection D of Section 22-8B-4.2 XXXX 0000 (2011). The School shall comply with all state and federal health and safety requirements applicable to public schools, including those health and safety codes relating to educational building occupancy.
