3.5.6.1 Interconnection Customer may, within thirty (30) Calendar Days after receipt of the draft report, provide written comments to Transmission Provider, which Transmission Provider shall include in the final report. Transmission Provider shall issue the final Interconnection Facilities Study Agreementreport within fifteen (15) Business Days of receiving Interconnection Customer's comments or promptly upon receiving Interconnection Customer's statement that it will not provide comments. Transmission Provider may reasonably extend such fifteen-day period upon notice to Interconnection Customer if Interconnection Customer's comments require Transmission Provider to perform additional analyses or make other significant modifications prior to the issuance of the final Interconnection Facilities Report. Upon request, Transmission Provider shall provide Interconnection Customer supporting documentation, workpapers, and databases or data developed in the preparation of the Interconnection Facilities Study, subject to confidentiality arrangements consistent with Section 5.6.1
3.5.7 Once an Interconnection Request has met all requirements to be offered an SGIA, including completed studies, Site Permit and environmental review, the Interconnection Customer must request a schedule for construction of the interconnection facilities (project). Transmission Provider and Interconnection Customer shall negotiate in good faith concerning the schedule for the construction of Transmission Provider's Interconnection Facilities and the Network Upgrades.
4.5.6 Upon completion of the Facilities Studyfacilities study, and with the agreement of the Interconnection Customer to pay for Interconnection Facilities and Upgrades identified in the Facilities Studyfacilities study, GUC the Transmission Provider shall provide decide whether to send the Interconnection Customer an executable interconnection agreement after completing necessary environmental documentation under the National Environmental Policy Act of 1969, 42 U.S.C. § 4321, et seq., as amended, concerning the interconnection of the Small Generating Facility; provided, that the Transmission Provider’s decision shall not be subject to dispute resolution. If the Parties agree to separately arrange for design and construction, and provided security and confidentiality requirements can be met, GUC the Transmission Provider shall make sufficient information available to the Interconnection Customer in accordance with confidentiality and critical infrastructure requirements to permit the Interconnection Customer to obtain an independent design and cost estimate for any necessary facilities.
4.5.3 In order to remain under consideration for interconnection, or, as appropriate, in GUC’s interconnection queue, the Interconnection Customer must return the executed Facilities Study Agreement or a request for an extension of time within an agreed upon timeframe.
4.5.4 3.5.5 A deposit of the good faith estimated costs for the Facilities Study facilities study may be required from the Interconnection Customer.
4.5.5 3.5.6 The scope of and cost responsibilities for the Facilities Study facilities study are described in the Facilities Study Agreementattached facilities study agreement.
4.5.6 3.5.7 Upon completion of the Facilities Studyfacilities study, and with the agreement of the Interconnection Customer to pay for Interconnection Facilities and Upgrades identified in the Facilities Studyfacilities study, GUC the Transmission Provider shall provide the Interconnection Customer an executable interconnection agreement within five Business Days.
