Common use of Failure of Allottee(s Clause in Contracts

Failure of Allottee(s. to take possession of Apartment – Upon receiving a written intimation from the Promoter as per para 7.2, the Allottee(s) shall take possession of the Apartment from the Promoter by executing necessary indemnities, undertakings and such other documentation as required and the Promoter shall give possession of the Apartment to the Allottee(s). In case the Allottee(s) fail(s) to take possession within the time provided in para 7.2 such Allottee(s) shall be deemed to be in such possession and the Allottee(s) shall be liable to pay maintenances charges, municipal tax and other outgoings and further pay holding charge of Rs.5,000/- (Rupees five thousand only) per month or part thereof to the Promoter for the period of delay in taking possession from such date as notified in the Possession Notice (Deemed Possession).
