Failure of Allottee to take Possession of Plot. Upon receiving a written intimation from the Promoter as per para 7.2, the Allottee shall take possession of the Plot from the Promoter by executing necessary indemnities, undertakings and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the Plot to the allottee. In case the Allottee fails to take possession within the time provided in para 7.2, such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.2.
Failure of Allottee to take Possession of Plot. [Apartment/Plot] - Upon receiving a written intimation from the Promoter as per para 7.2, the Allottee shall take possession of the plot [Apartment/Plot] from the Promoter by executing necessary indemnities, undertakings and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the plot [Apartment/Plot] to the allottee. In case the Allottee fails to take possession within the time provided in para 7.2, such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.2. Also in the event of Allottee’s failure to take possession or getting conveyance deed done in time limit, for any reason whatsoever, expenditure incurred on the taking care and/or maintenance of the apartment shall be charged extra at the rate of rupees thirty per sqm of the plot area plus taxes per month from the date onwards other than external maintenance charges, and be paid by the purchaser as and when demanded by the Promoter.
Failure of Allottee to take Possession of Plot. Upon receiving a written intimation from the Promoter as contemplated hereinabove, the Allottee shall take possession of the Plot by executing necessary indemnities, undertakings and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the Plot to the Allottee as per terms and conditions of the Agreement. In case the Allottee fails to comply with the essential documentation, undertaking, etc., or fails to take possession of the Plot within the time provided above, such Allottee shall continue to be liable to pay maintenance charges and holding charges as mentioned hereinafter.
Failure of Allottee to take Possession of Plot. Upon receiving a written intimation from the Promoter as per clause 7.2, the Allottee shall take possession of the Plot from the Promoter by executing necessary indemnities, undertakings and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the Plot to the Allottee. In case the Allottee fails to take possession within the time provided in clause 7.2, such Allottee shall continue to be liable to pay maintenance charges as applicable. On failure of allottee to pay the instalment as per schedule given in Buyer’s Agreement, apart from paying the interest on the delayed amount, the possession of the plot shall be extended to the extent of period of delay in paying the defaulted amount.

Upon receiving a written intimation from the Promoter as per Term No. 7.2 above, the Allottee(s) shall take possession of the Plot/unit from the Promoter by executing necessary indemnities, undertakings and such other documentation as prescribed in this Agreement and the Promoter shall give possession of the Plot/ unit to the Allottee(s). In case the Allottee(s) fails to take possession within the time provided as per Term No. 7.2 above, such Allottee shall continue to be liable to pay maintenance charges as specified under Term No. 7.2 above.
Failure of Allottee to take Possession of Plot. Upon receiving a written intimation from the Promoter as per clause 7.2, the Allottee shall take possession of the Plot from the Promoter by executing necessary indemnities, undertakings and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the Plot to the Allottee. In case the Allottee fails to take possession within the time provided in clause 7.2, such Allottee shall continue to be liable to pay maintenance charges and holding charges as may be determined by the Promoter/Maintenance Agency/Association of Allottees as the case may be. On failure of allottee to pay the installment as per schedule given in allotment letter, apart from paying the interest on the delayed amount, the possession of the Plot shall be extended to the extent of period of delay in paying the defaulted amount, subject to the payment of maintenance charges and holding charges.
Failure of Allottee to take Possession of Plot. Upon receiving a written intimation from the Promoter as per para 7.2, the Allottee shall take possession of the [Plot] from the Promoter by executing necessary indemnities, undertakings and such other documentation as prescribed in this Agreement, and the Promoter shall give possession of the [Plot] to the allottee. In case the Allottee fails to take possession within the time provided in para 7.2, such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.2.
Failure of Allottee to take Possession of Plot. Upon receiving the Possession Notice from the Developer and compliance of Conditions Precedent as per aforementioned sub-clause 6(ii) of this Agreement, the Allottee shall take possession of the Plot from the Developer within the time prescribed by the Developer in the Possession Notice by executing necessary indemnities, undertakings and such other documentation as prescribed in this Agreement and the Developer shall after satisfactory compliance by the Allottee of the Conditions Precedent and the Allottee not being in default under any of the provisions of this Agreement and having complied with all provisions and formalities, give possession of the Plot to the Allottee.

Possession by the Allottee – After obtaining the occupancy certificate* and handing over physical possession of the Plot to the Allottees, it shall be the responsibility of the Promoter to hand over the duplicate copy of necessary documents and plans, including common areas, to the association of the Allottees or the competent authority, as the case may be, as per the local laws.
