Common use of Familiarity with Work Clause in Contracts

Familiarity with Work. By executing this Agreement, Consultant represents and warrants Consultant: a) has thoroughly investigated and considered services to be performed, b) has carefully considered how services should be performed, and c) fully understands the facilities, difficulties and restrictions attending performance of services under this Agreement.

Should the Consultant discover any latent or unknown conditions materially differing from those inherent in the provision of such services or as represented by the Agency, Consultant shall immediately inform the Agency of such fact and shall not proceed except at Consultant’s risk until written instructions are received from the Agency.
