Federal Aviation Act, Section 308. Nothing contained in this Agreement shall be deemed to grant to Lessee any exclusive right or privilege within the meaning of Section 308 of the Federal Aviation Act, as codified in 49 USC § 40103, et seq., for the conduct of any activity on the Airport, except that, subject to the terms and conditions hereof, Lessee shall have the right to possess the Premises under this Agreement. The rights granted under this Agreement are nonexclusive, and County reserves the right to grant similar privileges to another lessee or other lessees for other parts of the Airport.

Nothing herein contained shall be deemed to grant to Concessionaire any exclusive right or privilege within the meaning of Section 308 of the Federal Aviation Act,1 as amended or succeeded, for the conduct of any activity on the Airport, except that, subject to the terms and provisions hereof, Concessionaire shall have the right to exclusive possession of the Premises leased to Concessionaire under the provisions of this Agreement.

Nothing in this Agreement shall be deemed to grant to AIRLINE any exclusive right or privilege within the meaning of Section 308 of the Federal Aviation Act for the conduct of any activity on the Airport, except that, subject to the terms and provisions of this Agreement, AIRLINE shall have the right to preferential possession of the Preferential Use Space leased to AIRLINE under this Agreement.
